Noble Avenue Real Estate – Colouring Competition Terms and Conditions

These Terms and Conditions apply to colouring competitions conducted by Noble Avenue Real Estate ("the Promoter").

By entering a competition, participants and, where applicable, their parents or legal guardians agree to these Terms and Conditions.

Competition-specific details, including entry dates, eligibility, age categories, prizes and winner announcement dates, will be published on the relevant competition webpage. Where competition-specific conditions differ from these general terms, the conditions published for that competition will apply, subject to applicable law.

1. Eligibility

1.1. Competitions are open to individuals who meet the eligibility requirements specified on the relevant competition webpage.

1.2. Participants under 18 years of age must have permission from a parent or legal guardian to enter.

1.3. Parents or guardians submitting entries on behalf of children confirm that they have the authority to do so and agree to these Terms and Conditions.

1.4. Where age categories apply, participants will be allocated to the appropriate category based on their age at the competition's closing date.

1.5. Entry is free. No purchase, property transaction or use of Noble Avenue Real Estate services is required.

2. Competition Period

2.1. Each competition will have an advertised opening date and closing date, as published on the relevant competition webpage.

2.2. Entries must be received before the advertised closing date and time to be eligible for judging.

2.3. Late entries may not be accepted.

3. How to Enter

3.1. To participate in a colouring competition, entrants must:

a) Download the official colouring sheet from the Noble Avenue Real Estate website or collect a printed copy from a participating agent, home open or the Noble Avenue Real Estate office.

b) Complete the artwork using their preferred colouring materials.

c) Provide the requested entry information, including the participant's name, age and parent or guardian contact details, where applicable.

d) Submit the completed artwork using one of the accepted entry methods specified for the competition.

3.2. Accepted submission methods may include:

• Dropping off the completed artwork at Noble Avenue Real Estate, 2/46 Angove Drive, Hillarys WA 6025.
• Emailing a clear photograph or scanned copy to admin@nobleavenue.com.au.
• Submitting the artwork through another method expressly identified on the relevant competition webpage.

3.3. Entries submitted through social media must be made by a parent or guardian where the participant is a child, and must comply with the rules of the relevant platform.

3.4. Participants must not publicly display personal contact information, including phone numbers, email addresses or residential addresses, when sharing their artwork online.

3.5. Entries must be the participant's own work. Reasonable assistance from a parent or guardian is permitted, provided the artwork substantially reflects the participant's own creativity and effort.

3.6. Noble Avenue Real Estate is not responsible for entries that are lost, delayed, incomplete or not received due to technical issues or circumstances outside its reasonable control.

4. Judging and Winner Selection

4.1. Colouring competitions are games of skill. Winners will be selected based on the merit of their entries and not by random selection.

4.2. Entries will be assessed using the following criteria:

• Creativity and originality
• Use of colour
• Overall presentation and effort
• Expression of the competition's theme

4.3. Where different age categories apply, entries will be assessed with consideration for the participant's age and developmental stage.

4.4. Judging will be undertaken by representatives appointed by Noble Avenue Real Estate.

4.5. Winners and runners-up, where applicable, will be selected from eligible entries received before the closing date.

4.6. The judges' decisions are final, subject to applicable law.

5. Prizes

5.1. Prize details, including the type, quantity, value and allocation of prizes, will be published on the relevant competition webpage.

5.2. Prizes are not transferable or redeemable for cash unless expressly stated otherwise.

5.3. Where gift cards or vouchers are awarded, they are subject to the issuing provider's applicable terms, conditions and expiry dates.

5.4. If an advertised prize becomes unavailable due to circumstances beyond the Promoter's reasonable control, Noble Avenue Real Estate may substitute a prize of equal or greater value, subject to applicable law.

5.5. Parents or guardians may be required to collect or accept prizes on behalf of participants under 18 years of age.

5.6. Noble Avenue Real Estate will not require winners to pay a fee to claim their advertised prize.

6. Winner Notification and Announcement

6.1. Winners will be announced on the date and through the communication channels specified on the relevant competition webpage.

6.2. Announcements may be made through Noble Avenue Real Estate's official website, Facebook page and Instagram account (@nobleavenuerealestate).

6.3. Winners or their parents or guardians will be contacted using the details provided with their entry, where available.

6.4. If a winner cannot be contacted after reasonable attempts within 14 days of the announcement, Noble Avenue Real Estate may select an alternative winner from the remaining eligible entries, based on the original judging criteria.

6.5. Personal contact details will not be publicly disclosed when announcing competition winners.

6.6. Where appropriate consent has been obtained, winners may be identified by their first name, age category and submitted artwork.

7. Personal Information and Privacy

7.1. Noble Avenue Real Estate may collect personal information necessary to administer the competition, including the participant's name, age, suburb, artwork and parent or guardian contact details.

7.2. Personal information will be used for purposes directly related to the competition, including:

• Processing and assessing entries
• Confirming eligibility
• Contacting winners or their parents or guardians
• Arranging prize collection or delivery
• Communicating competition results
• Managing competition-related enquiries

7.3. Personal information will be handled in accordance with applicable Australian privacy laws and Noble Avenue Real Estate's applicable privacy practices.

7.4. Contact details provided for competition entry will not automatically be added to promotional email or SMS marketing lists.

7.5. Where Noble Avenue Real Estate offers participants or their parents or guardians the opportunity to receive marketing communications, consent will be requested separately and participation will remain optional.

7.6. Participants or their parents or guardians may contact Noble Avenue Real Estate at admin@nobleavenue.com.au to enquire about their personal information or request correction or deletion, subject to applicable legal requirements.

7.7. Noble Avenue Real Estate will take reasonable steps to protect personal information against unauthorised access, misuse, loss or disclosure.

8. Artwork Ownership and Promotional Use

8.1. Participants retain ownership of their original submitted artwork.

8.2. By entering, participants and their parents or guardians acknowledge that Noble Avenue Real Estate may wish to showcase competition entries or winning artwork through its website, social media channels or related competition communications.

8.3. Where required, Noble Avenue Real Estate will obtain appropriate permission from the participant or their parent or guardian before publicly displaying identifiable artwork or associated personal information.

8.4. Any permission granted for the use of artwork will be non-exclusive and limited to competition-related promotional, community engagement and announcement purposes.

8.5. Noble Avenue Real Estate will not sell submitted artwork or license it to unrelated third parties for commercial use without separate permission.

8.6. Photographs or videos identifying children will not be published without appropriate parent or guardian consent.

8.7. Parents or guardians may contact Noble Avenue Real Estate to request that their child's name or artwork be removed from future promotional use. Reasonable requests will be considered and actioned where practicable.

9. General Conditions

9.1. Noble Avenue Real Estate reserves the right to verify the eligibility of entries and request reasonable supporting information where necessary.

9.2. Entries that are incomplete, fraudulent, inappropriate, infringe third-party rights or otherwise breach these Terms and Conditions may be disqualified.

9.3. Noble Avenue Real Estate may modify, suspend or cancel a competition where circumstances beyond its reasonable control prevent it from being conducted fairly or as advertised, subject to applicable law.

9.4. Any material changes to the competition will be communicated through the relevant competition webpage or other appropriate channels.

9.5. Participants are responsible for any ordinary costs associated with preparing and submitting their entries, including printing or internet access costs.

9.6. These Terms and Conditions do not exclude, restrict or modify any rights or remedies that cannot lawfully be excluded under Australian law.

9.7. Competitions are governed by the applicable laws of Western Australia and the Commonwealth of Australia.

10. Social Media Disclaimer

10.1. Competitions promoted through Facebook or Instagram are conducted by Noble Avenue Real Estate and are not sponsored, endorsed, administered by or associated with Meta, Facebook or Instagram.

10.2. To the extent permitted by law, participants release Meta, Facebook and Instagram from liability arising from their participation in the competition.

10.3. Questions about the competition should be directed to Noble Avenue Real Estate rather than Facebook or Instagram.
